A National Association of Realtors survey revealed, “only 64 percent of purchase contracts settled on time, 29% experienced delays and 7% fell apart.”Of the 7% that do not close, what gets in the way?

•    39% Financing issues
•    16% Appraisal disagreements
•    11% Title and deed problems
•    9% Inspections (so 9% of the 7%–or about 6/10 of a percent–that do not close are due to inspections)
•    8% Contingencies in the contract
•    The remainder – buyer or seller cold feet, HOA’s creating obstacles, buyers losing jobs.

Very few sales fail as a result of inspections.  A deal that failed because of negative inspection findings is probably a positive for the seller, buyer, and real estate agent. The president of an association representing B.C. home inspectors says an upcoming licensing-fee increase is a “money grab” that will hike prices for consumers and prevent people from entering the industry.

Bob Hamm is also calling on the provincial government to roll back the increase — 95 per cent over three years — and look into the activities of Consumer Protection B.C., the agency that licenses home inspectors and approved the fee hike.

“There’s absolutely no rational reason why they should be getting more money,” said Hamm, who is the head of the Home Inspectors Association of B.C. and a Kelowna-based home inspector. “They should be able to tighten up their process.”

HIABC is the largest of four associations representing home inspectors in the province. There are more than 500 licensed inspectors in B.C.

On Dec. 29, home inspectors received notice from Consumer Protection B.C. that their licensing fees will go up starting April 1. Renewals will increase by 25 per cent each year for three years, and the cost of a new licence will go up by 36 per cent this year, followed by 25-per-cent increases in 2019 and 2020.

By April 1, 2020, the cost of a licence renewal will almost double, to $1,025 from $525. The cost of a new licence will more than double over the same period, from $525 to $1,114.

Service Alberta charges a business with three or fewer licensed inspectors $500 for a two-year licence.

There will also be a two-per-cent annual increase for other charges over the next three years. Fees for replacement licences, late renewals and association accreditation have been eliminated.

In response to an interview request, Consumer Protection B.C. provided a statement from spokeswoman Tatiana Chabeaux-Smith.

“These fee increases reflect our need to recover costs for additional responsibilities we took on as a result of the changes made to the home-inspector regulatory model in September 2016,” the statement said.

According to the agency’s website, the responsibilities include assessing qualifications, administering new requirements and assuming responsibility for consumer inquiries.

However, Hamm alleged Consumer Protection B.C. isn’t doing the work as well as it should be, and that standards have fallen since it took over some regulatory duties from associations.

“This is a process that’s not working, that’s broken and that is damaging the industry when we could be going in a different direction and actually improving the industry,” Hamm said. “It may be that government doesn’t really appreciate exactly what Consumer Protection is not doing and it might be good for them to be aware of.”

That’s why when HIABC submitted an argument against the fee increase during stakeholder consultation in October, they copied Minister of Public Safety and Solicitor-General Mike Farnworth, Minister of Municipal Affairs and Housing Selina Robinson and Premier John Horgan.

Farnworth, whose ministry is responsible for the legislation covering Consumer Protection B.C., was unavailable for comment, but said in an emailed statement that the agency is a non-profit that operates at arm’s length from government, and is responsible for determining fees for the sectors it licenses, including home inspectors.

If the licensing fees increase at the expected rate, Hamm said the higher cost could dissuade people from entering the profession and be a burden on new inspectors. Customers will also be paying more for home inspections.

“That’s almost a hidden tax on consumers because businesses are going to pass that down to consumers — they have to, to stay in business,” he said.

Most of us who’ve worked in the trades for an extended time have developed procedures we use without a second thought. 

People who work with messy stuff have a supply of “dirty” rags nearby and, most likely, another one in their back pocket. Depending on the tasks of the day, there may also be a good supply of “clean” rags handy, too.

If the job is a bathroom remodel and the work is in the beginning stage, the dirty rags are needed, as is an old throw rug for just outside the door. A long, heavy painter’s drop cloth nicely covers the hallway, but the rug will catch most of the crud before you track it all about. This makes for much easier cleanup, as well as keeping the mess localized.When the project is winding down, the “clean” rags and rugs get deployed. The cleaner the task, the cleaner the rags needed. Cleaning while caulking and painting gets nasty if the rags or paper towels have plumbers’ grease, old wax ring pieces, or sawdust in them. As always, final cleanup needs fresh, clean rags and high-quality cleaning solutions like vinegar and water.

Rags and drop cloths are essential for those in-between parts of the project, too. A good drop cloth or rug laid out to protect the new flooring is needed when hanging a medicine cabinet and light fixtures. A dropped screwdriver or pliers can wreak havoc on new vinyl sheet-goods and baseboards. Heavy rags or, better yet, a sheet of corrugated (cardboard) laid on the floor and counter, then covered with rag rugs, will give a safe place to set tools and tool boxes. 

A sometimes-overlooked area that needs heavy-duty coverings is a new tub or shower. I know a contractor who spilled a can of purple cleaning primer for the PVC sink drain into the brand-new bathtub. The stain was not removable; he had to start the project over from the beginning. 

Another second-nature thing to many in the trades is closing the toilet lid and putting the stopper in sinks and bathtubs. This seemingly innocuous action will catch many dropped screw and nuts. 

When working on an outdoor deck hanging lights, or a screen door, a drop cloth will keep the errant dropped screw from falling between the boards. Seemingly small actions done with forethought help make projects flow smoothly About the House.

I had a long chat with Kim Smith, executive at HUB International on home inspection insurance and she really opened my eyes. Saying you are insured “should” mean you carry both general liability and errors and omissions insurance. I have heard of inspectors who claim insurance, but somehow the costly E&O is not in their policy. Kim commented that she got a number of calls for home inspectors out west during their initiation period who wanted to know if the “quickie” inspections or a “walk-thru” for a reduced fee was covered, the answer was “NO”. She also commented that in the hot Toronto market, it dramatically reduced home inspections and the real estate agents are now seeing an increase of law suits from buyers who passed on a home inspection. She also noted that in BC after licensing was enacted, her company did not see an upward spike in claims, a testament to those that remained were competent.

Recommendation #2: confirm your inspector has both kinds of insurance and his policy is current, a binder is produced by all insurance companies as proof they are professional enough to carry the full insurance coverage.


This last step should be one every home inspector in Ontario now knows. In the December 21 consultation paper from the Ministry of Government and Consumer Services it made reference to the Canadian CSA A-770 Home inspection Standard as the expected inspection method. It’s a lot more detailed than most other standards, we began using it when it was announced in March of 2016 and find for one inspector, done properly it often takes up to four hours. The days of the 1-2 hour inspection are gone.

Recommendation #3: ask your inspector if he is following the CSA standard, it’s expected to be the Ontario standard once licensing arrives and there is no reason not to use a standard that is available now.

It is a documented fact that a homebuyer who uses an experienced, skilled Home Inspector Brampton gains a wealth of knowledge on their prospective home, including in a few instances the information to understand when it’s time to walk away. However, of all the professionals involved in the purchase of a home, the only one in Ontario that has no governance is the home inspection industry. Ontario is in the process of changing this.


British Columbia and Alberta proceeded to license this industry a few years ago and they made some costly mistakes. I interviewed a number of home inspectors in, BC, Alberta and Ontario for this column. In BC, Vince Brunett is a former board member for both the BC Association HIABC and the National Home Inspection Certification Council (NHICC). He commented that the initial legislation was structured with the regional associations in control. This was a fiasco, one approved association did a weekend approval and processed 40-50 “inspectors” so they could get in under the wire. Today BC is in the process of taking it back the process at great expense and now has a government agency overseeing licensing.

Alberta was even worse, they got sold on a process, mostly by the internet associations to let nearly everyone in. Today they are doing the same, at considerable taxpayers cost, restructuring. Wayne Fulton, National Director with the NHICC told me he was in a government meeting in Alberta with 5 Service Alberta officials where they claimed they had done their homework, only to find out that the CMHC/NHICC program was ignored, due to the impact of the internet home inspectors lobbying. Wayne commented they realized they made a huge mistake but claimed it was too late to change the legislation, I understand they seriously regret that decision now.

At the recent American Society of Home Inspectors convention in Florida, Joseph W Denneler, one of the most recognized lawyers in the United States with respect to litigation of home inspectors, was quoted “many states have lowered the bar by allowing the easy path associations to be recognized which really can be detrimental to consumer protection” He went on to say “licensing is leveling the field of home inspectors..(who are) .. finally being recognized as professionals”.

Fortunately, it appears that Ontario has done its homework, the research done and the document “A closer look; Home Inspection in Ontario” (CLHIO) is the result of an independent panel of experts who presented a proper process for licensing. The licensing will function under a government administrative authority.


During my interview with Wayne Fulton he commented that he understood in British Columbia there were around 600 home inspectors before licensing, once the curtain came down, less than 300 remained. In chatting with Vince, he stated he could not confirm some of the rumors of discount inspections, quick walk-thru’s and a market flooded with coupons for “X” dollars off, but he did hear it happened. Wayne commented that it was known that the “internet” HI associations lobbied their way in for practically everyone to be licensed in both western provinces, a mistake many US states also made according to Attorney Joseph Denneler. Brian Callahan, an Ottawa home inspector and past OAHI director and chair of the Ottawa OAHI Branch simply told me “ most of the inspectors I see at meetings are scared, wondering how they can get around the coming licensing”

This year, with introduction of licensing expected by January 2019, it is conceivably that the time period is now where those that realize they are not going to make the cut or simply don’t want to be bothered upgrading, is a realization. Are they going to follow a similar path of discounts, “quickie” inspections and a walk-thru inspection with no written report, only time will tell but based upon the history out west, it’s almost a sure thing.

The CLHIO on page 52 clearly states “Home inspectors with the designations that reflect the licensing requirements of the new regulatory body and are approved by the regulatory body should become licensed without further review” Based upon my review of the CLHIO, there are only two organizations right now that fit the expected standard. They are the NHICC top certification NHI and the Ontario Association of Home Inspectors RHI.

There is expected to be a period of transition where examination and additional education/training will be offered to those that do not meet the standard, so that no one is forced out of business. However if the results in BC are any indication, there is going to be a lot of home inspection phone numbers that say “ This number has been disconnected” come 2019.

Recommendation #1: when you hire a home inspector, for now, insist they are an NHI or an RHI. You stand a 99.9% chance that they will be around once the licensing is enacted.

"I tell everybody pay the mortgage change the filters, it’s as simple as that."
